Veterans deserve a faster refund on GI Bill payments

Why it matters

Some service members paid extra into the Montgomery GI Bill to keep their benefits, then switched to the Post-9/11 GI Bill — which means the government owes those contributions back. Right now the law doesn't pin down when that check arrives. H.R. 1458 forces the VA to repay within 60 days of a veteran using up their benefits, starting August 1, 2026. The House passed it by voice vote, and it's now in the Senate.

H.R. 1458, the VETS Opportunity Act of 2025, doesn't create a new benefit. It cleans up how existing veterans' education rules work day to day.

The centerpiece is repayment timing. Service members who paid into the Montgomery GI Bill and later switched to Post-9/11 benefits are owed their contributions back. The bill says the VA has to cut that check no later than 60 days after a veteran exhausts their benefits. For veterans who don't qualify for a monthly housing stipend, the refund is a lump sum based on what they paid in and the months they had coming. Both changes kick in August 1, 2026.

Beginning with terms that start on or after August 1, 2026, independent study programs must require regular and substantive interaction between students and instructors to count for GI Bill benefits. Colleges in federal Title IV student aid, including for-profit schools, can now qualify to offer them.

Called up mid-semester? Three ways to handle it

After receiving service orders, a covered member picks one of three paths: withdraw from the course, take a leave of absence, or sign an agreement with the school to finish it. The finish-it option is available only if they've completed at least half the course already.

Schools get a set window of warning before compliance checks

The VA must give schools that use a time stamp database 10 to 15 business days' notice before a compliance survey. Every other school or training establishment gets up to 10 business days' notice.

Certifying officials hear about rule changes within 14 days

The VA has to notify all school certifying officials of any update to its certifying-official handbook within 14 business days. A certifying official is the school employee responsible for certifying veteran enrollment.

Who benefits from H.R. 1458?

Veterans owed money back on GI Bill contributions

Service members who paid into the Montgomery GI Bill and later switched to Post-9/11 benefits would get a hard 60-day deadline for their refund instead of an open-ended wait, starting August 1, 2026.

Service members pulled out of class by orders

A covered member who gets called to active duty, inactive duty training, or state active duty gets three clear choices: withdraw, take a leave of absence, or finish the course through a school agreement if they're already halfway through.

Veterans in independent study and online programs

Students in these programs get a stronger guarantee of instructor contact — starting with terms on or after August 1, 2026, the program has to provide regular and substantive interaction to count for benefits.

School certifying officials

The employees who certify veteran enrollment would get notified of handbook changes within 14 business days, so the rules they work under don't shift without warning.

Who is affected by H.R. 1458?

Schools enrolling veterans

Institutions would work within fixed compliance-survey notice windows — 10 to 15 business days if they use a time stamp database, up to 10 business days if they don't — and adjust to the new instructor-interaction standard for independent study.

Colleges in federal Title IV aid, including for-profits

Schools that participate in Title IV student aid become newly eligible to offer GI Bill independent study programs, provided those programs meet the regular-and-substantive-interaction requirement starting August 1, 2026.

Department of Veterans Affairs

The VA takes on new deadlines: 60-day refunds for eligible veterans, 14-business-day handbook notifications, and the new tiered notice windows before compliance surveys.

Veterans under the domiciliary-care pension cap

I support the improvements made by most of the bill, but I have concerns about some of the provisions within this legislation. Specifically, I worry that section 3 of the bill, which would authorize the use of post-9/11 GI Bill benefits for independent study programs taught at non-degree-granting, for-profit institutions, might be used by predatory operators to target veterans with subpar programs and rob them of the benefits they have so rightfully earned.

Madam Speaker, I rise today in support of H.R. 1458, as amended, offered by my friend and colleague, Representative Juan Ciscomani of Arizona. This bill would modernize the GI Bill by approving hybrid and online independent study programs to meet veterans' needs. During the COVID pandemic, these institutions offered classes in both online and hybrid settings to stop the spread of COVID. These institutions also received GI Bill funding during that time. Many of these institutions were even told to move their programs to fully remote.

As a proud United States Air Force veteran and voice for over 56,000 veterans and their families in North Carolina's First Congressional District, it was an honor to join and work with the gentleman from Arizona (Mr. Ciscomani) in introducing this bipartisan legislation. For too many veterans, the transition from military service to civilian life comes with uncertainty about how to build a new career and support their families.
